Article 1 — Definitions
- Bridge Performance: the sole proprietorship of Richard Ritmeijer, registered with the Dutch Chamber of Commerce (KvK) under number 63322498
- Client: the individual or legal entity entering into an agreement with Bridge Performance
- Consumer: a client acting as a private individual, outside a profession or business
- Services: all services offered by Bridge Performance, including expert coaching (individual and in groups) and hiring out as a professional bridge partner at tournaments
- In writing: communication by email or via the contact form on the website
Article 2 — Applicability
These terms and conditions apply to all offers, quotes, agreements and services provided by Bridge Performance. Deviations are valid only if agreed in writing. Any purchasing terms of the client are explicitly rejected.
Article 3 — Offers and formation of the agreement
- All offers on the website are without obligation, unless explicitly stated otherwise.
- An agreement is formed at the moment the client confirms a coaching engagement or hire in writing (by email).
- Bridge Performance has the right to decline a request or ask for additional information where there are reasonable grounds to do so.
Article 4 — Prices and payment
- Prices for coaching and hire are available on request and confirmed in writing per engagement, exclusive of applicable VAT (21% Dutch VAT) unless stated otherwise.
- Payment is made in accordance with the payment terms agreed in writing. In the absence of such agreement, a payment term of 14 days after the invoice date applies.
- If payment is not made on time, the client is automatically in default, and Bridge Performance is entitled to charge statutory interest and reasonable collection costs.
Article 5 — Right of withdrawal (consumers)
Important for consumers: if you purchase a coaching engagement as a private individual, you generally have a 14-day cooling-off period.
- Coaching (tailored engagements): the consumer has a 14-day cooling-off period after the agreement is concluded. If coaching has started earlier at the consumer's request, the right of withdrawal lapses in proportion to the service already delivered.
- To exercise the right of withdrawal, send an unambiguous written notice to info@bridgeperformance.nl, or use the withdrawal model form. Bridge Performance confirms receipt by email and refunds any amounts within 14 days, using the same payment method as the original payment.
Article 6 — Performance of the service
- Bridge Performance will make every reasonable effort to perform its services responsibly. Bridge Performance's obligations are best-efforts obligations, not obligations to achieve a specific result.
- The client is responsible for having the technical means required (a stable internet connection, suitable equipment) to take part in online coaching.
- Bridge Performance reserves the right to arrange a substitute in case of illness or force majeure. If no substitute is available, the service will be rescheduled or refunded free of charge.
Article 7 — Cancellation and rescheduling
- Cancellation by the client: free of charge up to 48 hours before the agreed session. Cancellations within 48 hours are charged at 50% of the session price. A no-show (failing to attend without notice) is charged at the full session price.
- Cancellation by Bridge Performance: in the event of a cancellation by Bridge Performance (illness, force majeure), any amounts already paid will be refunded in full, or an alternative date will be offered. Bridge Performance is not liable for consequential damages (e.g. travel costs).
- Cancellations must be reported in writing (by email) to info@bridgeperformance.nl.
Article 9 — Intellectual property
- All materials provided by Bridge Performance remain the exclusive property of Richard Ritmeijer and are protected by copyright.
- The client may not reproduce, distribute, publish or trade any materials without the express written consent of Bridge Performance.
- The client obtains only a personal, non-transferable right of use for their own use.
Article 10 — Liability
- Bridge Performance is liable only for direct damage that is the direct result of a demonstrable failure to perform the agreement.
- Bridge Performance is never liable for indirect damage, consequential damage, loss of profit, missed savings, or damage due to business interruption.
- If Bridge Performance is liable, liability is limited to the amount the client paid for the relevant service, with a maximum of €2,500 per event giving rise to damage.
- Bridge Performance is not liable for damage resulting from incorrect or incomplete information provided by the client, or from the client's lack of the required technical facilities.
- The client indemnifies Bridge Performance against third-party claims arising from the performance of the agreement, to the extent such claims result from acts or omissions of the client.
Article 11 — Complaints and disputes
- Complaints about the performance of the service must be reported in writing to info@bridgeperformance.nl as soon as possible, and no later than 14 days after the shortcoming was identified.
- Bridge Performance aims to handle complaints within 14 working days. If a longer handling period is needed, the client will be informed.
- If the complaint is not resolved satisfactorily, the consumer may submit a complaint via the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr. Bridge Performance is not affiliated with a recognized dispute resolution body.
- Dutch law applies to the agreement. Disputes will be submitted to the competent court in the district of Overijssel, unless the consumer chooses the court of their own place of residence.
Article 12 — Privacy
Bridge Performance processes personal data in accordance with the GDPR. See the privacy policy for more information on what data is collected, how it is used, and what rights the client has.
Article 13 — Changes
Bridge Performance reserves the right to amend these terms and conditions. The most current version is always available on the website. In case of material changes, active clients will be informed by email. Agreements already concluded remain governed by the terms in force at the time they were concluded.
Article 14 — Governing law
All agreements between Bridge Performance and the client are governed exclusively by Dutch law. The applicability of the Vienna Sales Convention (CISG) is explicitly excluded.
